I am currently on my first OPT which expires in June second week. The company which I am working for is an everified company, hence I applied for my STEM extension last week(I did not get the receipt of confirmation/the new OPT STEM extension card till now). As the STEM extension rules say that we can work for a maximum of 180 days without getting out OPT card, I thought its fine and hence applied a little late. The problem here is that my company is getting acquired by another company(this company is not e-verified, but they are planning to get everified, don't know when). It is still in the process of acquisition and the deal is expected to close by July. As this company is not everified(as of now) I cannot work for this company after my first opt expires, till it gets the everified status. As is a general phenomena that when a bigger company acquires another company, some cost cutting might happen. 1) Do you guys suggest applying for a H1B, with my current company (The problem is that even if my current company applies H1B, I cannot work for the new company as my H1 will be in processing and the new company is not everified, and I would be out of status. I cannot face this situation if the new company gets everified status before my first opt expires, but I am not sure if this is going to happen). I saw that too, but my problem is that i already had an appt for 3rd week of dec but I had an issue with my passport. Had to send papers for getting my name changed to my married name on the passport as the latest I797 i received was on my married name (noticed this only recently). Now I cannot change the name, passport etc on an existing appointment so will have to cancel the one I have. And currently only emergency appts are available for 3rd and 4th week of dec. Hence the dilemma!!!!! I was in same boat except my extention is for 3 year. I asked Att. Ron same that my labor and I 140 is approved and what if I leave this company and join new one and current one withdraw all papers. As per RON once you have I 140 approved and even if company withdraw it u can get 3 years unlimited extention with new company as long as new company apply for GC. Doesnot mean u need anything approved but should be under process. PERM or I 140 OR I 485. I have not seen the letter myself, but from the content, it appears to be a specific reply to your letter. I request you to get a couple of friends together and schedule a meeting with the Senators local office.
